Terms of Service

 

1. Scope

  These Terms of Service apply to all orders placed through the online store of Darlux Design, operated by:

  Boschstraße 1, 40589 Düsseldorf, Germany

  They apply to both consumers (B2C) and business customers (B2B), unless otherwise specified.  

 

2. Conclusion of contract

  By placing an order through our online store, you make a binding offer to purchase. The contract is concluded when we confirm the order by email or start production.

  All of our products are custom-made to order according to your individual specifications.  

 

3. Prices & payment

  All prices shown in the store are in Euro (€) and include statutory VAT (where applicable).

  Payment methods available: PayPal, Klarna, bank transfer, credit card (via Shopify Payments).

  Payment must be made in advance; production starts only after successful payment.  

 

4. Production & delivery

  Production time: approx. 4–7 business days.
  Delivery via DHL with tracking.

  Delivery times: Germany 2–4 business days, EU 5–10 business days, worldwide 10–21 business days.

  Delivery times may vary due to customs or international shipping conditions.  

 

5. Custom-made products

  All items are custom-made and personalized based on customer input (e.g. logos, wall art, awards, stickers, keychains).

  Therefore, each product may differ slightly in color, size or material appearance. Minor deviations are not defects.  

 

6. Right of withdrawal & returns

  According to § 312g para. 2 BGB and EU consumer law, the statutory right of withdrawal does not apply to goods that are manufactured according to customer specifications or clearly tailored to personal needs.

  Therefore, returns are excluded unless the product is defective or damaged upon delivery.

  If you receive a defective or damaged item, please contact us within 7 days of receipt at    info@darlux-design.de. We will arrange a refund or replacement.  

 

7. Warranty & liability

  Legal warranty rights apply for defects.

  We are not liable for damages caused by improper handling, installation or use.

  Our liability is limited to foreseeable, typical damages.  

 

8. Intellectual property

  All designs, images, product photos and logos on our website are protected by copyright. They may not be used, copied or distributed without prior written permission.  

 

9. Governing law & jurisdiction

  These Terms are governed by the laws of the Federal Republic of Germany.

  Place of jurisdiction: Düsseldorf, Germany, if the customer is a merchant, legal entity under public law or special fund under public law.
